General Terms and Conditions (GTC) of MOMcation
By accessing and using our MOMcation services, you acknowledge and agree to the terms of this agreement. In addition, when using specific services, you are subject to the posted guidelines or rules applicable to such services. Any participation in this MOMcation service constitutes acceptance of this agreement. If you do not agree with these terms, please do not use this service.
1. Accuracy Disclaimer
This website and its components are provided for informational purposes only. MOMcation assumes no responsibility or liability for the accuracy, usefulness, or availability of any information transmitted or made available via the website and is not liable for any errors or omissions in such information.
2. Intellectual Property
MOMcation and its original content, features, and functionality are the property of MOMcation and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
3. Payment
Payments must be made in euros and within the agreed deadlines unless otherwise stated in writing. If the contracting party fails to make payment within two weeks after receiving written notice, MOMcation reserves the right to terminate the agreement immediately without affecting MOMcation’s right to full payment of the agreed price.
If MOMcation has not received the full payment by the start date of the retreat, MOMcation reserves the right to refuse the participant’s attendance without affecting its right to full payment.
Any reasonable extrajudicial costs incurred by MOMcation after a reminder will be charged to the contracting party. If the total amount is not paid on time, statutory interest will be charged after written notice.
The contracting party’s right to offset debts against MOMcation is expressly excluded, unless MOMcation files for bankruptcy. The full payment becomes immediately due if:
- A payment deadline has passed.
- The contracting party becomes bankrupt or is granted a moratorium.
- The contracting party or its company is dissolved.
- The contracting party, as a natural person, becomes insolvent or dies.
4. Cancellation Policy
In case of cancellation, the contracting party must pay MOMcation the following fees:
- Up to 8 weeks before the MOMcation date: 0% refund
- More than 12 weeks before the MOMcation date: 25% refund
- More than 16 weeks before the MOMcation date: 50% refund
5. Rebooking
If a rebooking is requested, an additional fee of 10% of the room rate for the selected category will apply.
6. Notification of Changes
MOMcation reserves the right to amend these terms at its sole discretion. Continued use of MOMcation services will be deemed acceptance of any such adjustments.
7. Force Majeure
If MOMcation cannot take place due to unforeseeable circumstances, force majeure, or an insufficient number of participants, we reserve the right to cancel the event. In such cases, payments already made will be refunded, but no further compensation will be provided.
8. Childcare
MOMcation provides childcare during the retreat. However, parents or legal guardians remain responsible for supervising their children. MOMcation is not liable for any injuries, losses, or damages occurring during childcare.
Mothers traveling with children under 18 months are required, upon booking, to add the “dedicated babysitter” service and bear the additional costs. If this service is not selected at the time of booking, MOMcation reserves the right to add it afterward and charge the listed fee.
9. Travel Responsibility
It is the customer’s responsibility to ensure possession of all required travel documents and timely arrival at the airport.
9a. No Tour Operator Status / Third-Party Services
MOMcation does not act as a tour operator within the meaning of applicable travel law. MOMcation provides retreat coordination and experience design only. Accommodation, transportation, childcare, yoga sessions, excursions, catering, and any other services are provided either directly by independent third-party providers or in cooperation with such providers.
MOMcation does not own, control, or operate these third-party services and therefore assumes no responsibility or liability for the acts, omissions, negligence, accidents, delays, injuries, losses, damages, or failures of such third-party providers.
Any contract for third-party services is concluded directly between the participant and the respective service provider. The participant acknowledges that participation in any activity offered during the retreat is voluntary and at their own risk.
10. Transport Delays
MOMcation is not responsible for delays or failures of flights, trains, buses, or other transport means.
11. Retreat Changes
MOMcation reserves the right to modify accommodations or yoga activities.
12. Accommodation Changes
If a customer switches to a cheaper accommodation after payment, no refund will be provided. Upgrades will be charged at the new rate.
13. Health and Safety Regulations
Customers must comply with MOMcation’s health and safety rules. Participants with injuries or illnesses should seek medical advice before attending. MOMcation is not liable for injuries.
14. Personal Belongings
MOMcation accepts no liability for the loss or damage of personal belongings.
15. Limitation of Liability
To the fullest extent permitted by law, MOMcation shall not be liable for any direct or indirect damages, personal injury, illness, accidents, loss, or damage to property arising from participation in the retreat, including but not limited to accommodation, transportation, childcare, activities, or services provided by third parties.
MOMcation’s liability, if any, shall be limited to cases of intent or gross negligence and shall in all cases be limited to the amount paid by the participant for the retreat.
15a. Liability Disclaimer for Children
MOMcation is not liable for injuries to children, whether occurring during childcare or under parental supervision.
16. Complaints
Customers must direct complaints to MOMcation management and not discuss them with third parties.
17. Force Majeure and Refunds
MOMcation is not liable for unforeseeable events such as natural disasters, wars, pandemics, or flight cancellations. In such cases, no refund will be provided, but alternative solutions such as credits for future retreats may be offered.
18. Insurance
We strongly recommend that all participants obtain travel, cancellation, and health insurance for the duration of their stay.
19. Jurisdiction
These terms are governed by Spanish law, and any disputes shall be settled in Spanish courts.
20. COVID-19
If a participant tests positive for COVID-19 prior to travel, no refund will be issued. We recommend travel insurance to cover such situations.
21. DADcation Club – a branch of MOMcation Club
The DADcation Club is tailored to fathers, defining fathers with their children as the customer group. It operates entirely under the MOMcation Club umbrella and adheres to the same policies, values, and conditions outlined on this website. Unless stated otherwise, all references to MOMcation, MOMcation Club, the retreat, or “the company” apply equally to all DADcation programs and participants.
22. Family Edition by MOMcation Club
The Family Edition is designed for families, defined as two adults and up to three children under 18 years old. It operates fully under the MOMcation Club umbrella and follows the same policies, values, and conditions outlined on this website. Unless stated otherwise, all references to MOMcation, MOMcation Club, the retreat, or “the company” apply equally to all Family Edition programs and participants of the Family Edition by MOMcation Club.
